No, you do not need to file I485 for child, who is a us citizen. No medicals exam required, since they get everything here after birth.
But you have to mention child details on your I485.

I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.

Does anybody know which ASC in the bay area allows walk-ins? I missed my appointment and need to get this thing taken care of before I travel (I'm going to be out of the country Jan-Feb).
I tried walking into the San Jose center but they asked me to reschedule my appointment. I'd appreciate any advice.

If they are Singapore Passport holders they dont even need visa. Singapore (last I knew atleast) was a visa waiver country.

Let us be very clear, we are MORE THAN WILLING to associate with any org that can be beneficial to us. One of the members of IV had established contact with USINPAC and it has been a very fruitful association
If anyone can do the same thing with any other org (could be 'Chinese Physicians Association', or 'Russians in America' or 'Canadians in USA' or even 'Americans for High Skilled Immigrants' - please note that I made up all the names, but please get the gist) please take the inititative and let us know how it goes.
Also note, that even if we associate with an org primarily working for a particular country, all our issues will benefit EVERYONE from every country. It is impossible to press for an amendment like 'Ability to file I485 without regard to visa number for Indian Nationals only'. The US Government doesn't allow that and neither will IV go in that direction.
The keywords here are 'publicity and exposure'. We really need that to protect our amendments in the Senate and the House Conference

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.
Has anyone had their 485 approved with an RFE pending on EAD or AP?

I work for Company A from the year 2003 on H1-B Visa and here is my details
Priority Date : Aug 2004 (EB3-I)
I-140 Approved date : Jan 2007
I-485 Filed date : July 2007
Currently using : H1-B (8 th year running)
EAD & AP : I have both EAD & AP but not using it at this stage.
Now i got an offer from Company B but they can accept only EAD or GC with Good salary and position. I am really tired of getting low salary with company A as they started taking advantage of me.
Now if i use EAD card to move to company B (by using AC21) and once i get a green card (don't know when ??) do i have to come back to company A and work for one or two years as GC is for future employment ? Is there any rule like this ?
I am also planning to have my personal attorney after moving to Company B to take care of AC 21 and other communications.
I am not sure Company A will allow me to move at this stage and i cannot waste my life with this company for a low salary so i want to move and make some progress in my life.
Have any of you moved like this and got GC ? Will there be any issues ?
Please advise.

No, it;s not possible to get the approval letter for H4 in India. It is usually sent to your home address or lawyer's address in US.

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.

I got my first H1-B approval in 2008. I am originally from Mumbai and I have always got my previous visa stamps from the Mumbai consulate.
I paid my visa fees at an HDFC branch in Mumbai in the hope of getting an interview appointment in Mumbai this month. I am flying to India next week and I still do not see any open dates in Mumbai for the month of December. For some reason the VFS webpage displays open dates only at Chennai and Calcutta.
So the question... is it possible for me to visit the consulate in Chennai to get a visa stamp? Do I have to explain why I chose to come to Chennai instead of applying in Mumbai? Are there any other problems for people who choose a different consular district?
A quick survey on the US Consulate General - Chennai website only mentions to select the *most convenient* consular office. Right now I have at least one perfectly valid reason on why I should be granted an interview in Chennai.

And the lack of one or more of these factors is cited when ICE refuses to release someone."
So, has Morton announced a new policy or has he simply restated the existing policy in a way which suggests release, but, in fact, will lead to continued detention of asylum seekers?
Another unanswered issue is whether the policy will be followed by ICE officers throughout the country. Professor Margaret Taylor of Wake Forest University suggests it's an open question. "Hopefully there will be 'buy in' and compliance in the field offices with this policy, but history suggests otherwise."
For now let's take the Administration at its word. But time will tell whether the draconian policy of incarcerating people who seek refuge in America has finally come to an end.

Hello,
My 6 year H1 term expires on Feb-2010. I have a I-140 pending in NSC since July-2007 with no signs of movement.
Hypothetically, if my I-140 gets processed after Feb-2009 and is denied (God forbid!), then will I be able to extend my H1 visa? If so, on what basis can I do it?
I do understand that H1 can be extended only before 6 months of expiration if and only if I have a I-140 pending or approved.
