If, you have an approved EB3 and I-140 for a particular position from the same employer, and you file an EB-2 via PERM for the same employer, then there is a possibility of an audit and the first approved Lc on EB-3 rescinded. You, can however take your 5 years of experience and then file EB-2 for a different employer via PERM, provided your first employer does not withdraw your approved EB-3 I-140 petition. So my advise is get the best possible advice from the best lawyer and tread with caution.

Has anyone tried expedite requests .

1)If so , did the expedite requests via fax help?
2)The NCSC do not give us any fax number?
3)What would be the reason we can specify for expedite requests?

I called them this morning (I had other commitments earlier).
It was good to hear that they are now very aware of these bills.
Nearly all used the ploy "Where are you from?", to screen out those who are not from their district, but politely noted the call in their logs.
It was also good to be able to say that I had already spoken with my Congressman on the subject (because that's where they expect you to go first).
I've spoken with a lot of law maker's aids, and this ("where are you from?") is a ploy that is typically used when they have a high volume of calls. I would take that as a good sign.

    Guys,
We need your time, your enthusiasm on the advocacy days. IV is a grass roots organization. You are the grass roots.

We face problems of backlogs, and career uncertainty. IV is offering a solution, if implemented, it will bring relief to all. IV needs your help to deliver what you and I "NEED" AND "WANT".

    HELP IV HELP YOU.

We need heavy participation on the lobby days, I need volunteers from different states to ask me "How can I help?" instead, I am trying to find volunteers! I have been able to persuade members who have received GCs to help out, but getting members who are still in the mess are either unaware of the advocacy days (in spite of the thread running on the home page for the past month) or are not ready to talk to the employers to take the two days off. Capitol Hill runs on weekdays and therefore it is necessary for you to take the time off.

Come on guys, you can do better than this. Donors, members, guests - we are all in this together!

    Guys,

Its not a bad idea to put in efforts for citizenship. See it this way. We are already waiting for GC for years and will have to wait another 5 years for citizenship.

If all these useless wait is counted towards citizenship, then the wait at least yields some results. Right?

I am not saying we should not focus on GC. But if all these years of wait are really used, that would help EVERYONE. The ones who got their GC and the ones who don't have GC yet.

So no fret over this matter.

I think what GCPerm is trying to do is good for all, if we succeed.

macaca it does make sense. This si what they are doing...opening up the flood gates and allow for a flood. from this flood they will be able to easily approve 40k cases.

once that is done they will shut the flood gates so that the level starts moving towards equilibirium...with labor substitution ending on july 16th ...the 70k backlog elimination labor aps will be done quick enough.. since many will have redone their LC in PERM..and uscis will have an accurate headcount of people in line from this floodgate opening process.

i dont think we ll see retrogression back to 99... but maybe more mangeable levels

    Says who?

How do you know that US masters degree dont need to work for consulting firms?

Do US masters degree holders work for Deloitte? IBM Global Services? Accenture? KPMG? Price Water House Coopers?

What about Oracle consulting services? What about TRW? Bearingpoint?

All these are consulting companies or the divisions of consulting companies. Both US degree holders and the non-US degree holding duffers like myself work in consulting firms(I dont anymore since 2003). In fact, I have had my classmates from India have to look for consulting jobs after they did MS in computer science from USA.

You are under the impression that the bill is outlawing desi consulting firms and firms that exploit.

The bill outlaws OUTPLACEMENT. And the bill applies to all firms, desi firms and the big 5 consulting firms and your IBM, TRW ... everyone.

Please read the bill and read the description in the first post.

And although I am the last one to engage in US-degree versus non-US degree and Masters Versus Non-Masters fueds, I am tempted to say that US masters or US degree isnt worth a bucket of warm spit when the market is bad.

When the market is really bad, like it was in 2001 and 2002, I have seen many Masters degree holders pack up and throw in the towel and I have seen many individuals with degrees from private Tier 3 university from India survive just fine in an environment where there were 80 resumes for each IT job. The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT.

However if you are proud of your US degree and US masters, suit yourself. But dont say things like "I dont need consulting". Coz you really do and so do thousands of others having US degrees.
I take strong exception to following statements:

"The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT. "

The above statement is completely wrong. I needed assembly level programming and the binary math for designing satellite switched routers. There is no way to get packet processing time to less than a micro second without knowing assembly language and binary math. I have been in R&D for 3.5 years and I can assure all of you who are taking these courses that these courses are very relevant if you are looking for a job in high computing and high performance industry.

In addition I passed MS in 2001 and alongwith many others went through the same period of 2001 job market!

I read that there are 2800 EB3-I visas a year, or about 233 visas per month. Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:

    Sep-2010 : 10-Dec-2001

    Sep-2011 : 31-May-2002

    Sep-2012 : 15-Sep-2002

    Sep-2013 : 01-Jan-2003

    Sep-2014 : 01-Apr-2003

From there on the numbers are huge per month - about thousand pending 485 per month ... it'll continue at less than snail pace :D

Total Move in EB3 from Aug 28th 2009 to May 27th 2010.... is just 3,400...out of that
    250 from 2003,
    540 from 2004,
    445 from 2005,
    480 from 2006,
    550 from 2007

Total 2,265 from 2003 to 2007 that means those are Eb3->EB2/some other category moves...not the actual Approvals.

so looklike from Aug 28th 2009 to May 27th 2010...in EB3 we are having only around 1,140 aprovals....which is very very less, compared to 8,200+ approvals in EB2....

I'm not saying anything for the EB2 people...I'm saying EB3 is not moving compare to EB2.

Looking at the above table....I'm windering why we are not getting many approvals for EB3 as compared to EB2???

I can Understand why EB3 is in 2001 and EB2 in 2006... but we should get atleast same number of approvals right????

In that very less decrease in EB3 numbers, most of them are because of EB3->EB2 move,,,,,,

If this is the case, then Whencan i expect GC with EB3.... I may stop thinking about GC in near future.

    Hi All,

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

Throw in your input Gurus !

    Thanks

When USCIS sent you the RFE notice, you would have seen "Request for Evidence". After USCIS receives your response, you would have seen the hard LUD, while the header is still for RFE. Then after some days (with in 60 days), the header changes to "Request for Evidence Response Review", while the old header "Request for Evidence" vanishes. I was in the same boat like you. I spoke to my attorney's team and they offered me the insight glimpse of working of USCIS.

I am not sure how USCIS will interpret the above section as well.

    H1BLegal95,
I couldn't agree more with you. This is the worst thing to happen for ppl who have been patiently waiting in BEC lines since 2001 !!! Essentially this means that dates will get current for all the PERM filers since Mar 2005, giving them the advantage of AC21 while leaving simple ppl like you stuck. And then by the time your labor gets approved dates may not be current anymore.
But unless you are the type of person who's willing to get into buying labor certification there is nothing you can do! Is it unfair, hell yeah! Life's a b****. But remember you are getting screwed now others have either been screwed at some other point or will get screwed later. We all get screwed :D

    anandrajesh,
Are yuou out of your mind? You are asking a man who has been waiting in line since 2003 a spoilsport? If he was really a spolisport who would bought his way out by now. You want him to celebrate while you get AC21 and he's left waiting again? You have some nerve!
Why do you want a spoilsport bro. Everybody is rejoicing this moment. Let us not spoil everybody's moment here. I agree with ur reasoning, but the fact that everybody can apply for 485 brings justice to everybody. My PD is Mar 2004 and i am equally happy for all who can apply 485.
