    We should NOT be surprised that there is no movement in EB2/EB3 Categories given the number of applications filed recently. We may not see any reasonable forward movement for a long time unless congress passes the visa recapture bill.

    I don't think the July/August filings will have impact on the retrogression right away. The cut-off dates would retrogress based on number of applications ready for approval/approved pending VISA number. The applications (485) filed in July/August are not processed yet and hence will not impact retrogression today.

    Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. To put it were tersely "this is a bullshit suggestion" and is really wasting the purpose of this forum. The only reason so many people have responded is that it is "THAT RIDICULOUS"
    Hallo Sir, with all due respects, if you read carefully what the original post was, you would understand that its just another frustration arising from an individual who has / would spend around 40-50% of the avg productive life to achieve identification with the country he/she has contributed tremendously. Here nor the degree matters nor the salary matters, what matters is as he mentioned how many years you have been legally permitted to remain in this country. Regarding law of land, remember that the US is very close to permitting aprox 11 million undocumented people the road to permanent residency and citizenship. For which I believe a 10 year waiting period has been prescribed with fine payment. If such a rule can be thought of, why not count the number of years you/me are in this country working to enrich the economy + maintaining the inflow of cash into the social security/medicare etc. Please dont mininterpret me to be against the policy of granting legal status to undomented workers, definetely not. Now whether what the initial post suggests is ever going to happen is questionable, but his/her request for more respect is very much justified. Nobody (doesn't matter whether you are a junior/senior/moderator) has the right to ridicule another persons opinion unless that post is deliberately aimed at ciritisizing the IV agenda. Please honor each others freedom of thought and expression, OK. Thanks.

    I did an e-file of my EAD & AP on 14th April send the supporting docs that reached on 19th got second update as following on 04/20 no change since then anybody else had same experience.

    I know Congress passed earlier to recapture loast Visa's..can we urge USCIS to do an Admin fix of recapturing the Visa's based on precedence...why does the congress need to involved again?..

    well red and green u dont have to be so harsh.. a desi is willing to tell and share his success lets listen.. i know its pretty difficult to outsmart the people who have invested thousand of hours .
    last 4 yr of study tells me there is money to make , fastest way to make money..you have to make sure its safe..
    so i will like the idea of a yahoo group... i have spend almost 4yr * 2 to 3 hrs daily.. didnt make much money at all... but i can honestly tell you there is lot of oppurtunity here.. as long as you can spend time and be patient.. read stockbee blog its a good start.

    i like to hear trading strategy from anyone who is doing good..as long as they dont start selling snake oil..

    We can create a small area within IV forums for people to share knowledge on various non immigration subjects. What do you think?

    What is going to be the next step? Do we get the card or we need to wait for Approval Notice sent email and after that we get the card.

    If anybody can let me know, that will be great........

    it doesnt matter whether you get the approval notice or not. The card is the most important thing.
    The card usually takes anywhere from 3-5 days

    If, you have an approved EB3 and I-140 for a particular position from the same employer, and you file an EB-2 via PERM for the same employer, then there is a possibility of an audit and the first approved Lc on EB-3 rescinded. You, can however take your 5 years of experience and then file EB-2 for a different employer via PERM, provided your first employer does not withdraw your approved EB-3 I-140 petition. So my advise is get the best possible advice from the best lawyer and tread with caution.

    Yeah, go ahead and request that.
    Banning me is not the solution to your problems amigo.
    You guys (EB3-I) need to understand that "sympathy" is NOT a tenable legal position.
    Law is law, rules are rules.
    You cannot be planning to tramp all over patiently waiting EB2-I folks and expect to get away with it. Of course, I and probably several other people will undertake all legal efforts required to fight this (illegal) request from EB3-I.

    To the guy who lectured me on how great his experience was etc: I obtained my Masters in Mechanical Engg from Stanford. Of course, I am not going to tell you where I work and what I earn. You can speculate all you want about my "Skillz".

    To the guy who assured me that I am sinning and God will punish me: No, I don't think so. Fighting for the truth, and trying to fight for and protect my legal rights is not a sin. Speaking the truth is not a sin. I did not make EB1/EB2/EB3 categories. The government did. I did not screw people to have them apply in EB3, they should have known better.

    To the guys who say EB2-I folks do not care about them: OF COURSE they don't, you guys (EB3-I) are trying EVERY TRICK IN THE BOOK to have an advantage at our cost. This shall not stand.

    To anyone from the EB3-I cabal who wishes to engage with me: Try, and I will debate your points, any subject, any time (no IT please, I don't work in that miserable industry), regarding what is legal and good for EB3-I and also what is illegal and bad (mostly for EB2-I).

    Behind every visa number, is a person and most probably a family. Children. Parents. Spouses. Siblings. DO NOT preach to me that I don't know about the suffering. We each have our own suffering. I have mine. Unfortunately, I wish my suffering just involved my GC.

    Do you really think that whatever frustrations poured down here by whomsoever will force USCIS to change mind or its operational procedures changed? If not then why are you screaming so intensively? If this is the level one can achieve after joining Standford then we should now starting to doubt about the real quality level of Standford. But do not worry we will not judge Standford based on your behaviour here.

    People are pouring down their frustrations, ideas and possible solutions. One may be agree or disagree for a particular post/idea but upon disagreement no one should become uncivil.

    No impact on BEC approvals on retrogression, BECAUSE THEY NEED TO GET I-140 to be approved, then only their case to be on the line for visa number. Now no premium processing, their I-140 is going to get approved dring May OR June 2008. Till then the guys with I-140 approved and filed in June 2007 get GC. BEC approvals on 2001, 2002, 2003 cases after june 30th (last date for premium) will be on above catagory.

    Thanks for making me look like an idiot in front of my lawyer and HR, everyone.

    Based on RUMORs that "USCIS may get allergic reaction to too many 485 files, and stop accepting them in mid-July" I asked my lawyer this question:

    I have a question about July Visa bulletin. If the August bulletin is retrogressed when announced in mid-July, can the USCIS change rules and stop accepting new Adjustment of status petitions in mid-July ? I know that it sounds illogical and that July bulletin's current dates would apply thru July 31st but I am hearing from my professional colleagues that USCIS could change rules and stop accepting new AOS petitions in middle of the month.

    And I got this reply :

    Yes, what you raise is quite illogical. The visa bulletin controls which AOS can be filed during the calendar month for which it is published, there is no way for USCIS to stop receiving an AOS application received say on July 16th. AOS is not like an H1B filing, where there is a finite # that must be received by a date certain and then allocated.

    See, hear that ? "NO WAY FOR USCIS". Now, I dont know why some lawyers are spreading this nonsense that "BEWARE, USCIS will stop accepting new petitions if they receive 'too many petitions'. What is 'too many ??? Who defines 'too many'? Is 'too many' defined as the time when the mail room clerk gets back pain from lifting boxes of petitions ? Or the guy printing 485 receipt notices gets carpel tunnel syndrome ?

    PLEASE PUT THIS IDEA TO REST. USCIS WILL ACCEPT PETITIONS THRU JULY 31, NO MATTER HOW TIRED THEY ARE AND NO MATTER HOW SICK THEY GET OF SEEING 485 FEDEXes COMING IN DAY AFTER DAY AFTER DAY. GOT IT ????

    - Grant option to have citizenship or green card to those who have been working for US for 10years or more without getting out of status.
    - Issue one time executive order to grant green cards to those who have Priority Dates older than 7 years.
    - Visa re capture if above two are not issued.
    - Count primary applicant as a visa number and not dependents.
    - If none of above are done at least deny/approve I-485 application as soon as possible and issue green cards later so that applicants know what they should do with their lives.
    - If none of the above are possible, please shut the immigration.
