With new DOL policies and increasing immigration and labor standards enforcement, approval rates for labor transfers are down drastically. AILA reports even approval rates for PERM are down to 62% from the 80% approval rates seen earlier. Be careful, and have another parallel 'regular' filing so in case your sub labor gets rejected you don't loose additional Piority Date time.

Hi all,
I am new to this thread. I have a bachelor degree in Applied Science in IT and got it in about 1 and half years because I got an points exemption from my advance diploma. I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?
Hope to hear from kind soul soon.
Thanks,
Clive

My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.
The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.
What would be my best options. Please reply ASAP

I currently have a full time H1 but one of my past employers asked me if I can work on a advisory basis on a part time for 10 hrs per week. As I can have 2 h1's . My questions are
1. During any PERM, 140, 485 stage with my first employer, do I have to or will my first employer come to know about my part time H1
2. Can I file for PERM . Green card from my pat time h1
thanks

My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.
Anyone here succeed in this?
Thank you very much!

Hello,
Is PERM filed online only or it can be filed by snail mail as well ?
If is filed online, does the attorney get the receipt number immediately ?
If it is filed by snail mail, how long does it take for the attorney to get the receipt number ?
Your response is greatly appreciated.
Regards

both of us are physicians working on h1b visas .we have ead's.i want to do a fellowship.i believe i cannot do a fellowship using my ead.can i use my wife's ead, showing myself as a dependant?all help from the gurus will be greatly appreciated.thanks.
EAD is employment authorization document. Your analogy is like -
"Can I use her driving licence to drive around town". I am not sure if that is what you meant.
If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

The image also has the leaning-to-the-left feel to it.
Absolutely! I wonder if it could be those trees again. It looks like the barn is straight compared to the slanted tree in the middle.
Maybe a chain saw is called for? :D

Dear All,
It seems my company had audit and my employer was asked to submit client letters for all employees.
Q's is will it have any impact on 485 process for the employees in case of any issues in the company in other areas ?
Please let me know.
Please be more specific. What kind or audit - DOL, IRS, US CIS?

Ive a serious problem with my D2H. The photometer is not working at all!!!! The top display is showing always HI (or a very hi speed when I put the diaphragm at maximum) even with the optics cover closed. Ive reset (with the green buttons) the camera but the problem persist. Ive removed the battery > switched camera on > camera off again > insert the battery but no solution.
The ISO value is at 200.
Ive switched on different positions the metering selector several times nothing!
Ive removed the memory card nothing!
The rest is working perfectly, so I can take pictures with an external photometer (which I dont have here now) or based on my light condition experience but this is not the point!!! Actually, I usually takes wilderness and travel photography and an external photometer makes me very difficult the practices. In addition, Im living in Guinee (in the middle of nowhere) at this moment, them there is not Nikon service here of course!!!
Please, any suggestion? Advice?
Ive not Internet access all the time, only to check my mail account. Could you please send your messages to my account too? jordi@espel.net A million of thanks in advance.

Hi gurus,
I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.
1)Would this affect my I-140 processing
2) Would this create any issues in the future stages of the green card process
3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)
Sincerely appreciate your time and help.
Regards,
Vijay

Another great design, but the text seems a bit off with the design. For the most part, in a stamp, the text should be the consistent, dull part. In my view, it doesn't look nice when italicized or stylized excessively.

You would require copy of the approval notice of 140 from the old company.
In the new company, you would need to file a new labor via PERM. Once it is approved, you would need to file a new 140 and use the copy of the old approved 140 to port your priority date.
