I am so sorry for what you must be going through. There are certain visas/immigration law provisions to assist victims of violent crime. With respect to your first query, as an applicant for AOS you will retain legal immigration status even if you engage in non-H-1B employment using an EAD. You will, however, lose "lawful non-immigrant (H-1B) status" if you perform work for any entity that has not petitioned for H-1B status on your behalf.
Keep in mind that merely applying for and obtaining an EAD has NO impact on your lawful H-1B status. So, given life's uncertainties, it's generally a good idea to obtain EAD and Advance Parole just in case H-1B employment is lost.

My PD is not in this range. Mine is July-2001 kind of >= 2002.
I have seen an ALIA observation on EB2 Retro. Trying to figureout how soon these Visa #'s for EB2 catagory is vanished. I will have an analysis from this will post here.
This polls just captures two recent retors one for Jan & Other for Feb. I just pulled EB-2 dates from VB and thrown a random survey.

My PD June 2007, RD Oct 2007. No REFEs. EB1 India.
Thanks for all the help and good counsel.
Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.
In this process, I made so many friends and learned to heed others views and good advice.
Will continue to work for IV.

I94: The number should be same for all. You need a copy of most recent one. Although, layers have been taking copies of all I94s. To be on safer side, you can send copies of all I94s.
AP: You can travel on valid AP. Return before it expires.
Renewd AP: It will have new valid dates. When you get this (in USA) then you can use it for travel. I am not sure whether it is OK or not OK to tell friend to mail it in your country of visit and try to come back on this.

The text is printed on your SSN card based on your visa status at the time of application. EAD is also a temporary status, this also requires a renewal. Hence, you would not be able to "remove" the text from your SSN card until your receive the GC.
Hi, Sorry if this has been asked already.. I am on H1B and the primary applicant... Can I change my SSN to remove "Work with Authorization only" statement on SSN by using EAD?
I am planning to stay on H1B and I dont want to invalidate H1B by doing this.

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?
If you are out of country for more than a year, your 6 year starts over.

AT JFK. Just showed AP and passport. Went through US citizen/resident line, again to separate counter and no questions. Very cool and very very friendly CBP officers.

No, you don't have to apply for a new H1 if the previous company did cancel your H1 and the H1 has not expired. A dormant H1 can be reactivated at any time.

That was up from 44 audits in fiscal 2009 and just one audit in 2008. A company can be fined up to $1,100 for each illegal employee, and knowingly violating verification laws can lead to criminal charges and forfeited assets.
So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Hi,
There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,
I have not found much info on this topic and so, decided to post this question.Thanks in advance for your replies.

I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?

On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

I'm starting a thread where we can report on alliances with other organizations, i.e. organizations which have agreed to support us in one form or another.
We appeared in the Bay Area India Community Center Newsletter for the second week in a row (http://app.e2ma.net/app/view:CampaignPublic/id:866.211583623/rid:8370aaa2ef6135414a14bf8135c0bfb7). We are looking forward to organizing future events with them.
I also reached out to NetIP's bay area chapter -- we are trying to work out the specifics of how we can educate their members, and how they can help us.
It would be great if the core group filled us in on other existing alliances.
